OVERVIEW
Welcome to picobini! The terms “we”, “us” and “our” refer to picobini, operated by Picobini Babytextilien e. U., owner: Tommy Ochsenhofer, Seitenstettengasse 5/37, 1010 Vienna, Austria (company register number FN 690292k, Commercial Court of Vienna, VAT ID ATU83757613). picobini operates this store and website, including all related information, content, features, tools, products and services, in order to offer you baby clothing for rent on subscription (the “Services”). picobini is powered by Shopify, which enables us to provide the Services to you.
The following terms and conditions, together with all policies referred to herein (these “General Terms and Conditions” or “Terms”), describe your rights and obligations when using the Services.
Please read these General Terms and Conditions carefully, as they contain important information about your legal rights and cover areas such as term, returns, warranty and liability.
By placing an order, you agree to these General Terms and Conditions. You can find out how we process your personal data in our Privacy Policy (https://picobini.com/en/policies/privacy-policy). If you do not agree to these General Terms and Conditions, you should not use our Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these General Terms and Conditions, you confirm that you are of legal age.
To use the Services, including to take out a subscription or exchange your box, you will be asked for certain information, e.g. your email address, billing, payment and shipping information. You confirm that all information you provide in our store is correct, current and complete and that you have all rights necessary to provide this information.
You are responsible for the security of your login details and for the activities in your account. You may not transfer, sell, assign or license your account to third parties.
SECTION 2 – OUR PRODUCTS
We rent out baby clothing in boxes. The content and number of items depend on the package, size and season and are described on the respective product page. We put the individual items together for you. Images in the store show examples; the specific items, colours and brands in your box may differ.
The clothing in your box may already have been worn by other families, unless stated otherwise for the respective package. We clean and inspect every item before we ship it.
We have made every effort to present our products and services accurately. Please note, however, that colours and appearance may differ from how they are displayed on your screen, depending on your device and its settings.
We may change or discontinue our offering for new orders at any time and limit the quantities we offer per person or region.
SECTION 3 – ORDERS AND CONCLUSION OF CONTRACT
When you place an order, you make an offer to conclude a subscription for the rental of baby clothing. picobini may accept or decline your order. Your order is only accepted once picobini confirms acceptance by email. We must receive and process your payment before your order can be accepted. If we do not accept, change or cancel an order, we will notify you at the email address provided with the order.
Please check your order carefully before submitting it. You can cancel your order until your first box has been shipped. After that, the rules on withdrawal and cancellation apply.
Exchanges, returns, cancellation and withdrawal are governed by our Refund policy (https://picobini.com/en/policies/refund-policy). There you will also find the information on the right of withdrawal and the model withdrawal form. You can also declare your withdrawal online: https://picobini.com/en/pages/vertrag-widerrufen
You confirm that you rent the clothing for personal use in your household and not for commercial purposes, sub-letting or resale.
SECTION 4 – SUBSCRIPTION, TERM AND CANCELLATION
When you order, you choose a package (Starter, Family or Premium), a size and a minimum term of 6 or 12 months.
Your subscription and the minimum term begin when you receive your first box.
You take out your subscription for the chosen minimum term: the price for the entire minimum term (monthly price times 6 or 12) is owed and is billed in monthly instalments. Ordinary cancellation is not possible during the minimum term. Your statutory right of withdrawal and your right to terminate for good cause remain unaffected.
After the minimum term, your subscription continues indefinitely on a monthly basis at the same monthly price. You can then cancel it in your customer account or by sending us a message, no later than 24 hours before the next charge; it ends with the month already paid for. Before the minimum term ends, we will remind you by email that your subscription will continue monthly unless you cancel.
As long as your subscription is running, you can keep your box or exchange it for a different size (0–18 months). Within 6 months, you can exchange your box up to 3 times.
SECTION 5 – RENTAL CLOTHING: OWNERSHIP, USE AND CLOTHING PROTECTION
The clothing in your box is rental property and remains our property. This does not apply to items that you keep or buy under the rules of your package: with the Premium package, you may keep up to 2 boxes with a 6-month minimum term, or up to 4 boxes in total with a 12-month minimum term. You decide whether to keep a box when you exchange it or at the end of the subscription, as long as your allowance has not been used up; any further box goes back to us. If your subscription continues monthly after the minimum term, no further boxes are added to this allowance; you can still exchange your box until your subscription ends. With the Starter and Family packages, you can buy the entire box you are currently using at any time; we will tell you the price on request before you buy. Ownership of these items passes to you, with the Premium package as soon as the price for your minimum term has been paid in full, and in the case of a purchase upon payment of the purchase price.
Please treat the clothing with care and wash it according to the care label. You may not sell, sub-let, dye, permanently label or otherwise permanently alter the rental clothing.
Clothing protection is included. It covers stains and damage that occur during normal use; we do not charge anything for this. Loss and intentional damage are not covered.
Items that are missing or not returned are charged per item according to the following price list: socks (pair) €3, bib €4, hat €5, tights €6, bodysuit €7, T-shirt €7, joggers €10, sweater €12, jacket €25. If an entire box is not returned even after a reminder, we charge for its items according to this price list. You remain entitled to prove that we have suffered no loss or a smaller loss. We will ship your next box as soon as this amount has been paid.
SECTION 6 – EXCHANGES AND RETURNS
If the size no longer fits, you exchange your box for a different size on our website. You send the previous box back as soon as the new one has arrived, at the latest 10 days afterwards.
After your subscription ends, you send your box back to us within 14 days. With the Premium package, you do not need to return the boxes you are allowed to keep under Section 5.
For the return, use the enclosed return label and hand the parcel in at the post office. Please keep the receipt until we have confirmed that the parcel has arrived.
SECTION 7 – PRICES AND BILLING
The monthly price shown for the chosen package and term at the time of your order applies. It is stated in your order confirmation email. All prices are final prices in euros. The total price for the minimum term is the monthly price times the number of months (6 or 12). We show shipping costs before you complete your order.
Billing is monthly via the payment method you have chosen. You pay the first monthly price when you order. Only if you choose a start date in the future (pre-order) is this payment an advance payment: we do not charge anything else until your start date, and once you receive your first box, we count it as your first subscription month. The next charge is made one month later and monthly thereafter.
The monthly price of your current subscription remains unchanged during the minimum term. Prices, discounts and promotions for new orders may change at any time.
From time to time we may offer promotions that affect pricing and are subject to separate terms. In the event of a conflict between the terms of a promotion and these Terms, the terms of the promotion take precedence.
You agree to provide current, complete and correct payment and account information and to update it promptly, including your email address and your payment method details, so that we can process your payments and contact you if necessary. You confirm that you are authorised to use the payment method provided.
If a charge fails, we will inform you and try again. As long as amounts are outstanding, we may suspend exchanges and further deliveries.
SECTION 8 – SHIPPING AND DELIVERY
We currently deliver within Austria only. We ship your box within 5 working days of your order, or on the chosen delivery date for pre-orders.
Delivery times stated are estimates. Delays caused by carriers or by events beyond our control may occur. Your statutory rights in the event of late delivery remain unaffected.
We bear the risk of the box being lost or damaged on its way to you. Please check your box on arrival against the enclosed list and report any missing or damaged items to us straight away.
SECTION 9 – INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, videos and audio, and their design, selection and arrangement, are the property of picobini, its affiliates or licensors and are protected by copyright, trademark and other intellectual property laws.
These Terms permit you to use the Services solely for your personal, non-commercial use. Without our prior written consent, you may not reproduce, distribute, modify, publicly display, publicly perform, republish, download, store, transmit or create derivative works of any of the material on the Services. Unless expressly provided otherwise herein, nothing in these Terms grants you, or shall be construed as granting you, a licence or other rights under any patent, trademark, copyright or other intellectual property of picobini, Shopify or any third party. All rights not expressly granted herein are reserved by picobini.
picobini's names, logos, product and service names, designs and slogans are trademarks of picobini or its affiliates or licensors. You may not use these trademarks without picobini's prior written permission. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are trademarks of their respective owners.
SECTION 10 – OPTIONAL TOOLS
As part of the Services, you may be given access to customer tools offered by third parties. We do not monitor these tools and have no control over or input into them.
We provide access to such tools without any representations and without endorsement. Your use of optional tools is at your own discretion. You should therefore familiarise yourself with the terms of use of the relevant third-party tools. Our liability is governed by Section 20.
We may also offer new features through the Services in the future (including the release of new tools and resources). Such new features also form part of the Services and are subject to these General Terms and Conditions.
SECTION 11 – EXTERNAL LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties (including embedded third-party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you access.
Please review the third party's policies and practices carefully before entering into any transaction there. Complaints, claims, concerns or questions regarding third-party products and services should be directed to the respective third party.
SECTION 12 – RELATIONSHIP WITH SHOPIFY
picobini is powered by Shopify, which enables us to provide the Services to you. Your contractual partner is picobini alone. Shopify is not a party to your contract with us.
SECTION 13 – PRIVACY POLICY
All personal data we collect through the Services is subject to our Privacy Policy (https://picobini.com/en/policies/privacy-policy), and certain personal data may be subject to Shopify's privacy policy.
Because the Services are hosted by Shopify, Shopify collects and processes personal data about your access to and use of the Services in order to provide and improve the Services for you. Data you submit to the Services is transmitted to and shared with Shopify and with third parties that may be located in a country other than the one you live in, in order to provide services to you. For more information on how we, Shopify and our partners use your personal data, please see our Privacy Policy.
SECTION 14 – FEEDBACK
If you send us ideas, suggestions or feedback, we may use them free of charge to improve our Services. We may publish reviews and other content that you submit for publication in the store and in our advertising free of charge; you can withdraw this consent at any time with effect for the future.
Please only send us content for which you hold the necessary rights and which is neither unlawful nor offensive. We may remove such content.
SECTION 15 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally, information on or in the Services may contain typographical errors, inaccuracies or omissions that may relate to product descriptions, prices, promotions, offers, shipping costs, delivery times and availability. We reserve the right to correct any such errors and to change or update information at any time. If an order is based on an obvious error, such as a clearly incorrect price, we will inform you and may cancel the order; in this case we will refund any payments already made.
SECTION 16 – PROHIBITED USES
You may only use the Services for lawful purposes. You may not access or use the Services, directly or indirectly, for the following purposes: (a) for any unlawful or malicious purpose; (b) to violate any applicable law; (c) to infringe our intellectual property rights or the intellectual property rights of third parties; (d) to harass, abuse, defame, intimidate or harm our employees or other persons; (e) to submit false or misleading information; (f) to send, knowingly receive, upload, download, use or re-use any material that does not comply with these Terms; (g) to send or arrange the sending of advertising or promotional material, including junk mail, chain letters, spam or similar unsolicited messages; (h) to impersonate or attempt to impersonate another natural or legal person; or (i) to otherwise engage in conduct that restricts or inhibits anyone's use of the Services or that could harm picobini, Shopify or the users of the Services or expose them to liability.
In addition, you agree not to: (a) upload or transmit viruses or other types of malicious code that are or may be used in any way that affects the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or otherwise exploit any part of the Services; (c) collect or track the personal data of others; (d) misuse the Services for spam, phishing, pharming or pretexting; (e) use robots, spiders, scraping tools, data gathering and extraction tools or other automated means to access the Services, except as permitted by Section 17; or (f) interfere with, circumvent or manipulate the security or authorisation features, the robot exclusion headers or other measures we use to restrict access to the Services.
SECTION 17 – AUTOMATED ACCESS
Automated access to the Services, e.g. by bots, scrapers or AI agents, is only permitted if they identify themselves as such in their user agent string, comply with our technical requirements (e.g. robots.txt) and do not circumvent any protective measures. We may technically restrict or block such access.
SECTION 18 – SUSPENSION AND TERMINATION BY US
We may suspend your access to the website if you breach these Terms.
We may terminate a current subscription for good cause with immediate effect, in particular if you are in default of payment despite a reminder or use the rental clothing contrary to these Terms. In this case, you must return your box to us without delay. You remain obliged to pay all amounts due up to the termination date.
The following sections continue to apply after termination: Rental clothing, Exchanges and returns, Intellectual property, Feedback, Warranty, Liability, Gift cards and discounts, Severability, Waiver; Entire agreement, Assignment, Governing law, place of jurisdiction and dispute resolution, Privacy Policy, and all other provisions which by their nature should survive termination.
SECTION 19 – WARRANTY
The statutory warranty rights apply to the rental clothing. We provide the clothing to you cleaned, inspected and in usable condition. If an item is defective or missing on delivery, we will replace it free of charge. Normal signs of wear on previously worn clothing are not a defect.
The information provided on or via the website is for general information purposes. We strive to ensure its accuracy but cannot guarantee that the website will be available at all times without interruption, securely or free of errors. Your statutory rights remain unaffected.
SECTION 20 – LIABILITY
We are liable without limitation for damage caused by us intentionally or through gross negligence, for damage resulting from injury to life, body or health, and in accordance with product liability law.
In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for the contract. Essential obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely. Otherwise, our liability for slight negligence is excluded.
These rules also apply in favour of our employees, representatives and service providers.
SECTION 21 – GIFT CARDS AND DISCOUNTS
You can buy picobini gift cards in the store and redeem them for subscriptions with picobini. A gift card is valid for 5 years from the date of purchase. Any remaining balance is retained until the end of the validity period. Gift cards are transferable. Balances do not earn interest and are not paid out in cash, unless the law provides otherwise.
Term discount: with a minimum term of 12 months, the monthly price is around 10% lower than with 6 months. The monthly price shown at the time of your order applies.
Early-bird discount: with the discount code from the pre-registration, you get 15% off the first 6 monthly payments of your subscription. The code can be redeemed until 31 January 2027, applies to subscriptions with a minimum term of 6 and of 12 months and can be combined with the term discount, but not with other discount codes.
Discount codes do not apply to the purchase of gift cards.
SECTION 22 – SEVERABILITY
If any provision of these General Terms and Conditions is unlawful, invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected. The invalid provision shall be replaced by the statutory provision.
SECTION 23 – WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these General Terms and Conditions shall not constitute a waiver of that right or provision.
These General Terms and Conditions, together with all policies we publish on this website and your order confirmation, constitute the entire agreement between you and us. Individual agreements with you take precedence.
SECTION 24 – ASSIGNMENT
You may not transfer this contract or your rights and obligations under these Terms to third parties without our prior written consent. If we transfer the contract to another company, we will inform you in advance; in this case, you may cancel your subscription without notice.
SECTION 25 – GOVERNING LAW, PLACE OF JURISDICTION AND DISPUTE RESOLUTION
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory protective provisions of the country in which you have your habitual residence remain unaffected.
For consumers, the statutory places of jurisdiction apply. For all other customers, the court with subject-matter jurisdiction at picobini's registered office has jurisdiction.
Alternative dispute resolution: we are not legally obliged to participate in dispute resolution proceedings before a consumer arbitration body. If you have a complaint, please contact us first (https://picobini.com/en/pages/contact); we will try to find an amicable solution. In Austria, arbitration bodies include the Internet Ombudsstelle (www.ombudsstelle.at) and the Schlichtung für Verbrauchergeschäfte (www.verbraucherschlichtung.at). We decide on a case-by-case basis whether we participate in proceedings.
SECTION 26 – HEADINGS
The headings used in this agreement are for convenience only and do not limit or otherwise affect these Terms.
SECTION 27 – CHANGES TO THE GENERAL TERMS AND CONDITIONS
The most current version of the General Terms and Conditions can be viewed on this page at any time. New orders are subject to the version published at the time of the order.
A current subscription is subject to the version that applied when you placed your order. Changes only apply to your current subscription if you agree to them or to the extent that they are required by law. We will inform you of planned changes by email.
SECTION 28 – LINKS TO OUR WEBSITE
You may link to our website. You alone are responsible for the content of your own website; we accept no liability for it. If you culpably infringe the rights of third parties there and claims are made against us as a result, you shall indemnify us against these claims.
Links to our website may not be placed on pages whose content is unlawful, e.g. offensive, defamatory, pornographic or criminal, or that infringe the rights of others or call for such infringement.
We may at any time require you to remove a specific link or all links to our website. You shall comply with this request without delay.
We may change these rules for links with effect for the future; the version published on this page applies. Anyone who continues to link to our website thereafter accepts the amended version. Section 27 applies to your current subscription.
If you consider a link on our website or a page linked by us to be inappropriate, write to us via https://picobini.com/en/pages/contact. We review every notice and remove links to unlawful content as soon as we become aware of it. Beyond that, we are not obliged to remove a link or to reply to you individually.
SECTION 29 – LIABILITY FOR WEBSITE CONTENT
We compile the information on our website with care. However, we do not guarantee that it is complete, correct and up to date or that the website is available at all times.
If you use our website without concluding a contract with us, e.g. to obtain information, we are only liable for intent and gross negligence. Sections 19 and 20 apply to contracts with us.
In any case, liability for injury to life, body or health, liability for fraudulent or deceitful conduct, liability under the Product Liability Act and any liability that cannot be limited or excluded under applicable law remain unaffected. This applies equally to you and to us.
These rules apply to all claims in connection with our website, regardless of whether they are based on contract, damages or the breach of statutory obligations.
